This agreement allows only noncommercial use of the datasets for academic, instructional, or noncommercial research purposes. Instructional use is narrowly defined as classroom use by instructors in non-profit educational institutions. Prohibited commercial use includes use of the data for any purposes for which financial consideration will be received. Acceptable noncommercial use excludes research conducted by academic personnel under consulting agreements with clients from private industry, government, or other entities.
If you wish to use the data for any other purpose, contact BOTEC Analysis, LLC to discuss a collaborative agreement under a commercial license.
Prohibition against Redistribution of Data
You agree not to redistribute data or other materials without the written agreement of BOTEC Analysis, LLC, unless you are collaborating with other users (who have also agreed to these terms and conditions) to analyze the data for academic, instructional, or noncommercial research purposes. Your acknowledgement of this agreement includes responsibility to verify that any collaborators have also submitted this agreement.
The prohibition against redistributing data also precludes sharing the data, alone or in combination with other research data, during or after the process of publishing the findings of research in an academic journal. Instead, requestors of the research data must be referred to this BOTEC Analysis, LLC site so that their own access can be approved. This prohibition includes posting the data to a journal’s data archive.
You agree to reference the recommended bibliographic citation in any publication that makes any use of the data. The citation when using the data should be in two entries as follows:

Authors of working papers (i.e., pre-publication versions of reports or articles) and publications based on the data agree to send a copy of the written work and the suggested citation to BOTEC Analysis, LLC. The citations will be included in a database of publications related to the data archive on this website. The copy of the written work will not be posted on this website unless the author so requests. The written work and the citations should be sent to firstname.lastname@example.org.
Freedom to Publish
You have the freedom to publish the results of research making use of the data without the prior consent of BOTEC Analysis, LLC, provided that the recommended bibliographic citation as described above is included in the article or paper.
You acknowledge that BOTEC Analysis, LLC, Cornerstone Research, Altria Client Services, and Altria Group, Inc. bear no responsibility for use of the data or for interpretations or inferences based upon such uses.
If BOTEC Analysis, LLC determines that the terms of this agreement have been violated, BOTEC Analysis, LLC may act to sanction the user in accordance with applicable law. Sanctions can include but are not limited to:
- Revocation of the existing agreement, demand of the return of the data in question, and denial of all future access to data from BOTEC Analysis, LLC
- Reporting the violation to the Research Integrity Officer, Institutional Review Board, or supervisor of the user’s institution.
